Judge turns back jailed dentist's bid for trial

A former dentist at the center of a U.S. Supreme Court ruling over the involuntary medication of mentally ill defendants lost his request that he be tried in late November.

In turning back Charles Sell's bid, U.S. District Judge Donald J. Stohr said November 22, 2004, he would decide later whether the dentist is mentally capable of being tried on charges of Medicaid fraud, mail fraud and murder conspiracy.

Stohr in July had found Sell found competent to stand trial, saying the man's mental condition had improved to the point he can assist in his own defense and understand court proceedings.
