Priority in Ex Vivo Gene Therapy Cases To Be Determined

Somatix Therapy Corporation, Alameda, California, announced that the Patent and Trademark Office (PTO) has declared an interference between a pending patent application licensed to the company, a patent application of a second company, and a patent recently issued and licensed to Genetic Therapy, Inc., Gaithersburg, Maryland.

The U.S. patent, number 5,399,346, was issued on March 21, 1995, and lists as Inventors Drs. W. French Anderson, Michael Blaese, and Steven Rosenberg. When issued, its claims were widely interpreted as encompassing the entire field of ex vivo gene therapy.
