State Employees Union Files Lawsuit



July 4th, 2008

In a hand-delivered letter to Gov. Rendell (follows) David R. Fillman, Executive Director for Council 13 of AFSCME, the American Federation of State, County, and Municipal Employees, invited the Gov. and State Treas. Wiessmann to join AFSCME, PSSU, and FOSCEP in a lawsuit filed in Commonwealth Court this morning. AFSCME seeks to establish once and for all whether the Gov. has the authority to continue to employ all Commonwealth workers who are covered by the Fair Labor Standards Act (FLSA) in the event of a budget impasse.

AFSCME Council 13 represents more than 45,000 state employees. Over 14,000 of these employees are considered "non-critical" and will be furloughed...
