Nu Flow and Nu Flow Installers to Cease "Patented" References as Part of Settlement of Federal Patent False Marking Lawsuit with ACE DuraFlo

ACE DuraFlo(R) Systems, LLC ("ACE") has partially resolved its lawsuit against Nu Flow America Inc. and Nu Flow Technologies (2000) Inc. (collectively, "NU FLOW") arising out of, among other things, NU FLOW's representations that NU FLOW "holds many patents" and that certain products are "patented." ACE sued NU FLOW under the federal patent false marking statute (35 U.S.C. section 292) and for false advertising. ACE claimed that NU FLOW had misrepresented that certain products were patented and that NU FLOW did not hold many patents as it had represented.
