International Trade Commission Again Vindicates Korea Kumho Petrochemical Co., Ltd.

The U.S. International Trade Commission (ITC) has, for a second time, ruled in favor of Korea Kumho Petrochemical Co., Ltd. ("KKPC"), by terminating an investigation initiated by Flexsys America L.P. ("Flexsys"). In this second ITC investigation initiated by Flexsys to suppress legitimate competition by KKPC in the United States, the ITC upheld a prior ruling by its Chief Administrative Patent Judge Paul J. Luckern that KKPC was entitled to summary determination in its favor.
