Lawyer to appeal court ruling on late-term procedure

More challenges are in store for an Ohio law that bans a late-term abortion procedure called "partial-birth" abortion by opponents.

Cincinnati attorney Alphonse Gerhardstein said the December 17, 2003, 2-1 ruling by the 6th U.S. Circuit Court of Appeals upholding the Ohio law will be appealed to the full appeals court or to the U.S. Supreme Court.

Gerhardstein represents Martin Haskell, MD, whose Women's Medical Professional Corp. performs abortions at clinics in Cincinnati and Dayton. He contended that appeals court judges disregarded the record in the case.
