Patent infringement suit against Dow Agrosciences to move forward

Published reports of a U.S. Patent Office ruling may leave a mistaken impression concerning Cargill's lawsuit against Dow AgroSciences, Dow AgroSciences Canada, and Canbra Foods over specialty canola oil patent infringement, Cargill officials say.

While the Patent Office has dismissed, based largely on procedural grounds, Cargill's attempts to have two Dow AgroSciences patents awarded to Cargill as the true inventor, the ruling has no impact on a separate lawsuit Cargill filed in U.S. Federal Court in Portland, in Sept. 2003, alleging infringement on four of Cargill's own canola oil patents. The two issues are unrelated from a legal standpoint.
