Pharmaceutical company to appeal U.S. District Court decision on Sporanox patent

Janssen Pharmaceutica Products, L.P., will appeal a U.S. District Court decision in New York that found that Eon Labs Manufacturing Corporation, Inc., does not infringe Janssen's patent on Sporanox (itraconazole) capsules.

The suit had been initiated by Janssen in April 2001 in response to Eon's filing of a paragraph IV certification under the Hatch-Waxman Act.

The judge upheld the validity of the patent, but found Eon's product did not infringe the patent.

The company will appeal the decision to the Court of Appeals for the Federal Circuit in Washington, D.C.
