New Mexico state insurance chief criticized for role with health foundation

New Mexico State Insurance Superintendent Eric Serna is facing criticism for his role as head of a health foundation that has received more than $100,000 in contributions from the industry he regulates.

A 39-year-old mother of five from Albuquerque contends Serna's relationship with the foundation influenced his decision to uphold her HMO's ruling denying her a potentially life-saving bone marrow transplant.

"In a lot of cases, issues like conflict of interest or due process are just abstract issues," said Zelphoe Maloney's attorney, Bobby Mayfield. "But in this case, they are having a real impact on people's lives."
