Appellate court revives claim that vaccine disabled boy

A Cary, North Carolina, couple who blame a childhood vaccine for their 11-year-old son's developmental disabilities has been given another chance to take their case to the state Industrial Commission.

The state Court of Appeals sent the case back to the commission March 1, 2005, because only 2 commissioners reviewed the appeal instead of the required three.

The commissioners affirmed a ruling that denied the family's claim that their son's injuries were vaccine-related. Andrew and Catherine Goetz hope to recover the maximum of $300,000 allowed under state law for their son's disabilities.
