Defendant in Olympia HIV assault case waives jury trial

A man charged with exposing 27 women to the virus that causes AIDS and with trying to talk some out of testifying against him has waived a Washington State jury trial.

Instead, Thurston County Superior Court Judge William Thomas McPhee granted a request by lawyers for Anthony M. Whitfield, 32, to hear the case without a jury.

"I think the issues that we're dealing with are emotional," defense lawyer Charles Lane said. "The risk is that's what the jury will focus on, as opposed to the legal issues."
