Judge Denies Motion for Class-Action Status in Lawsuits

A federal judge has denied motions to give class-action status to lawsuits accusing two tampon manufacturers of failing to protect women from toxic shock.

U.S. District Judge Frank Theis, Wichita, Kansas, issued his order March 15, 1996 in a lawsuit against Playtex Family Products Corp. and another lawsuit against Tambrands Inc.

The companies are accused of knowing for at least a decade that their products could put women at risk of toxic shock syndrome, but failed to make the products safe.

Theis ruled that women in toxic shock cases have many dissimilar traits and a class action was not the best way to resolve the cases.
