Oral pleadings in Implanon appeal

Today NV Organon presented oral pleadings as part of its appeal against the first instance judgement made by the court in 's-Hertogenbosch on June 15, 2005 regarding the contraceptive rod Implanon.

The case was brought against Organon and 13 general practitioners in 2002 by 15 women who became pregnant while they thought they were using Implanon. The claimants became pregnant because Implanon was not present in their arm.

The claimants want the court to decide who is liable for their unintended pregnancies. The court heard the pleadings of all parties on April 12, 2005 and made its first instance judgement in June 2005 that Organon or the doctors or...
